Japan court OK's Nissan ex-Chairman Ghosn's release on bail

A Tokyo court approved the release of former Nissan Chairman Carlos Ghosn on 1 billion yen ($8.9 million) bail on Tuesday, rejecting an appeal by prosecutors to keep him jailed, a lawyer for the auto executive said.
He could be freed as soon as Wednesday morning, according to Japan's Kyodo News.
Jean-Yves Le Borgne, Ghosn's French lawyer, said a court issued a late-night ruling rejecting prosecutors' appeal of the initial ruling. Le Borgne cautioned that prosecutors still had leeway to file new charges as they had done once before.
Ghosn said in a written statement that he is grateful for his family and friends who had stood by him "throughout this terrible ordeal."
He said he is "innocent and totally committed to vigorously defending myself in a fair trial against these meritless and unsubstantiated accusations."
The former head of the Renault-Nissan-Mitsubishi Motors alliance has been detained since he was arrested on Nov. 19. He says he is innocent of charges of falsifying financial information and of breach of trust.
His Japanese lawyer, Junichiro Hironaka, is famous for winning acquittals in Japan, a nation where the conviction rate is 99 percent.
Hironaka said the legal team "proposed concrete ways showing how he would not tamper with evidence or try to flee."
Hironaka said Monday that he had offered new ways to monitor Ghosn after his release, such as camera surveillance. Hironaka also questioned the grounds for Ghosn's arrest, calling the case "very peculiar," and suggesting it could have been dealt with as an internal company matter.
In Japan, suspects are routinely detained for months, often until their trials start. That's especially true of those who insist on their innocence.
The 1 billion yen bail set by the court was relatively high but not the highest ever in Japan.
Among the conditions for Ghosn's release were restrictions on where he can live, his mobile phone use, as well as a ban on foreign travel and contact with Nissan executives, according to Kyodo News. |

Republicans pitch keeping Court of Appeals at 15 judges

North Carolina Republican legislators now want to give up on the law they approved two years ago that reduces the number of Court of Appeals judges from 15 to 12 as retirements and other vacancies arise.
A state Senate judiciary committee Tuesday recommended unanimously a bill that would keep the court's size at 15 after all. Bill sponsors say the measure, if agreed to by the full General Assembly, should end as moot a lawsuit filed by Democratic Gov. Roy Cooper challenging the 2017 law. A key House GOP leader said later that he believed party members in his chamber are inclined to go along with the repeal.
A trial-judge panel actually sided with Republicans last year in upholding the law, but the state Supreme Court scheduled oral arguments in the case for March 4. With registered Democrats a strong majority on the Supreme Court, there's uncertainty about whether they'll be inclined to uphold the law.
"I think we still feel the rationale for the bill was appropriate, but this will end the lawsuit with the governor, and so that's why we're going forward with it," said Sen. Warren Daniel, a Burke County Republican and a chief bill sponsor.
The law is one of several approved by the GOP-controlled legislature since December 2016 — just before Cooper took office — that have eroded Cooper's powers. In this case, it would prevent Cooper from filling three vacancies when they occur, because the seat would be simply eliminated.
No vacancies have occurred on the intermediate-level court since the law took effect, but the first could come next month. Court of Appeals Judge Bob Hunter, a registered Republican, must step down March 31 after meeting the state-mandated judicial retirement age of 72 the day before.

The Latest on the sentencing of Michael Cohen, a former lawyer for President Donald Trump (all times local):
The outspoken lawyer for porn star Stormy Daniels has turned up at the federal courthouse in Manhattan where Michael Cohen is scheduled to be sentenced for crimes including a hush-money payment to the performer.
Michael Avenatti represented Daniels in a legal dispute with Cohen in which she sought to be released from the non-disclosure agreement.
Avenatti has bashed Cohen for months on cable television, saying President Donald Trump's former lawyer deserves to go to prison.
Cohen's sentencing will begin Wednesday at 11 a.m.
Cohen pleaded guilty to evading $1.4 million in taxes, bank fraud and campaign finance violations.
Prosecutors say the $130,000 payment Cohen made to Daniels exceeded legal limits.
His lawyers say some of his crimes were motivated by overenthusiasm for Trump.
New York prosecutors have urged a judge to give Cohen substantial prison time. |

Court could deal blow to porn star, award Trump legal fees

Lawyers for President Trump want porn actress Stormy Daniels to pay them $340,000 in legal bills they claim they earned successfully defending Trump against her frivolous defamation claim.
The attorneys are due in a Los Angeles federal courtroom Monday to make their case that they rang up big bills because of gamesmanship and aggressive tactics by attorney Michael Avenatti, who represents Daniels.
Daniels, whose real name is Stephanie Clifford, alleges she had a one-night affair with Trump in 2006. She sued him earlier this year seeking to break a non-disclosure agreement she signed days before the 2016 election about the tryst as part $130,000 hush money settlement. Trump has denied the affair.
Despite the deal to stay quiet, Daniels spoke out publicly and alleged that five years after the affair she was threatened to keep quiet by a man she did not recognize in a Las Vegas parking lot. She also released a composite sketch of the mystery man.
She sued Trump for defamation after he responded to the allegation by tweeting: "A sketch years later about a nonexistent man. A total con job, playing the Fake News Media for Fools (but they know it)!"
U.S. District Court Judge S. James Otero ruled in October that Trump's statement was "rhetorical hyperbole" against a political adversary and was protected speech under the First Amendment. Trump is entitled to legal fees, Otero said.
Trump's team of lawyers have accounted for more than 500 hours of work — at rates as high as $840 an hour. |

Malaysia court to resume Kim Jong Nam murder trial on Jan. 7

A Malaysian court on Wednesday set Jan. 7 for two Southeast Asian women charged with murdering the North Korean leader’s half brother to begin their defense, as their lawyers complained that some witnesses were unreachable.
A High Court judge in August found there was enough evidence to infer that Indonesian Siti Aisyah and Vietnamese Doan Thi Huong, along with four missing North Korean suspects, had engaged in a “well-planned conspiracy” to kill Kim Jong Nam.
The women appeared somber but calm during Wednesday’s hearing. The trial had been due to resume Nov. 1 but was postponed after a defense lawyer fell ill.
Aisyah’s lawyers made a new application to the court to compel prosecutors to provide them with statements that eight witnesses had given to police earlier.
Her lawyer, Kulaselvi Sandrasegaram, said they were informed that one of the witnesses, the man who chauffeured Kim to the airport, had died while two Indonesian women who were Aishah’s roommates were believed to have returned to their homeland. She said they have only managed to interview two of the witnesses offered by prosecutors, while two others didn’t turn up for their appointments and couldn’t be contacted.
The witness statements taken by police are important in “the interest of justice” and to ensure that what they say to defense lawyers is consistent with what they told police, Sandrasegaram told reporters later.
Prosecutor Iskandar Ahmad said the police interviews are privileged statements and shouldn’t be made public.
Judge Azmi Ariffin said the court will make a decision on the defense application on Dec. 14. He also set 10 days from Jan. 7 through February for Aishah’s defense and 14 days from March 11 through April for Huong.
The two are accused of smearing VX nerve agent on Kim’s face in an airport terminal in Kuala Lumpur on Feb. 13, 2017. They have said they thought they were taking part in a prank for a TV show. They are the only suspects in custody. The four North Korean suspects fled the country the same morning Kim was killed.
Lawyers for Aisyah, 25, and Huong, 29, have told the judge they will testify under oath in their defense.
They have said their clients were pawns in a political assassination with clear links to the North Korean Embassy in Kuala Lumpur, and that the prosecution failed to show the women had any intention to kill. Their intent is key to concluding they are guilty of murder. |

Porn actress Stormy Daniels' lawyer Michael Avenatti must pay $4.85 million to an attorney who worked at his former law firm, a California judge ruled Monday in an order that holds the potential presidential candidate personally liable in a lawsuit over back pay.
The Los Angeles judge ordered the payout the same day a separate ruling came down evicting Eagan Avenatti LLC from its office space in Southern California after four months of unpaid rent.
In the case over back pay, Los Angeles Superior Court Judge Dennis Landin ruled that Avenatti personally guaranteed a settlement with attorney Jason Frank, who said Eagan Avenatti misstated its profits and that he was owed millions of dollars.
Avenatti, who is best known for representing Daniels in her lawsuit against President Donald Trump following an alleged 2006 affair, did not appear at Monday's hearing and never filed arguments in the case. |
