Lawmakers push back against Washington high court

Washington state's highest court has exercised an unusual amount of power on education funding, and it's prompted some lawmakers to raise constitutional concerns.
Before last year's legislative session, the court ruled that the state wasn't meeting its obligation to amply pay for basic education. In response, the Legislature added about $1 billion in school-related spending, and lawmakers widely agree they'll add more funding in coming years.
Earlier this month, the court went a step further, analyzing specific funding targets while telling lawmakers to come back with a new plan by the end of April.
Those specific demands have irked budget writers in the Legislature.
"They are way out of their lane," said Republican Sen. Michael Baumgartner.
Baumgartner expects lawmakers will continue adding "substantially new resources" to the state education system, but he said the court's position could erode the proper balance of power in Olympia. Baumgartner hopes lawmakers will ignore the court's latest demands, or he fears justices may exercise more power going forward. |

High court OKs Miss. lawsuit on LCD price fixing

The Supreme Court has ruled unanimously that Mississippi can pursue claims of price-fixing against a manufacturer of LCD screens in state court.
The justices on Tuesday reversed a lower court ruling that blocked the state-court suit against AU Optronics Corp.
Justice Sonia Sotomayor, writing for the court, said the New Orleans-based 5th U.S. Circuit Court of Appeals was wrong to order that the case be tried in federal court.
The issue was whether the federal Class Action Fairness Act, aimed at taking class-action lawsuits from consumer-friendly state courts to more business-friendly federal courts, also applied to cases filed by a state on behalf of its residents.
Taiwan-based AU Optronics is one of several Asian companies sued for fixing prices for thin film transistor liquid-crystal display panels from 1999 to 2006. |

Tenino man pleads guilty to child pornography

The U.S. attorney's office says a Tenino man pleaded guilty Friday in federal court in Tacoma to possession of child pornography.
As part of a plea agreement, prosecutors are recommending a four-year prison term when 47-year-old James Donald Mobley is sentenced in March.
The U.S. attorney's office says the former teacher at Tenino Elementary School is one of 348 people arrested worldwide as part of the "Project Spade" investigation into a Toronto-based website.
Investigators found Mobley purchased child pornography from the company. He was arrested last January. A search of his computer found 650 photos and 45 videos of child pornography. |

N. Ind. court helps veterans get back on track

A northern Indiana judge is helping troubled veterans get their lives back in order.
Porter Superior Judge Julia Jent started the Veterans Treatment Court slightly more than two years ago. Case managers, mental health professionals, prosecutors and public defenders work to help veterans who have had a run-in with the law try to solve some of the problems they are facing.
On Friday, six military veterans who graduated from the program. Sixty-three-year-old Paul Hake of Porter says it completely change his life. Hake is a Marine veteran who served in Vietnam. He says he had a problem with alcohol, but now he has his life back.
The class was the third graduating class since the program began. |

Planned Parenthood Asks Supreme Court's Help In Texas

Planned Parenthood is asking the Supreme Court to place Texas' new abortion restrictions on hold.
The group says in a filing with the high court Monday that more than a third of the clinics in Texas have been forced to stop providing abortions since a court order allowed the new restrictions to take effect Friday.
Planned Parenthood says that the 5th U.S. Circuit Court of Appeals went too far in overruling a trial judge who blocked the law's provision that requires doctors who perform abortions in clinics to have admitting privileges at a nearby hospital.
The filing was addressed to Justice Antonin Scalia, who oversees emergency matters from Texas. |
