Court: Montana minimizes impact of mining near Yellowstone

A gold exploration proposal near Yellowstone National Park faced a significant setback as a judge blamed Montana officials for understating the potential for mining to harm land, water and wildlife.
The ruling released Friday means the Montana Department of Environmental Quality would have to conduct a lengthy environmental review before Lucky Minerals can proceed.
The Vancouver, Canada, company received approval last year to begin searching for gold, copper and other minerals at 23 locations in Emigrant Gulch, a picturesque area of steep mountains and dense forest in south-central Montana's Paradise Valley. It has a long history of small-scale mining.
The results of the exploration work would guide the company's future plans for commercial-scale mining.
Environmental groups sued over the project last year on behalf of local residents, who are concerned mining could reduce tourism and pollute the nearby Yellowstone River.
State Judge Brenda R. Gilbert agreed with the environmentalists that state officials gave too much deference to the company in considering the project and ignored evidence that water supplies could be damaged.
The agency also should have looked more closely at the project's impacts on grizzly bears and wolverines and considered the broader implications if Lucky Minerals expands onto federal lands, Gilbert said. |

Supreme Court dismisses Microsoft search case

The Supreme Court has dismissed a dispute between the Trump administration and Microsoft over emails the government wanted as part of a drug trafficking investigation.
The justices on Tuesday agreed with both the administration and Microsoft that last month's passage of the Cloud Act as part of a spending bill resolves the dispute and makes the court's intervention unnecessary.
The legislation updated a 32-year-old law that governs how authorities can get electronic communications held by technology companies. The issue was whether Microsoft had to turn over emails that were stored on its server in Ireland.
The Cloud Act makes clear that the government can obtain the emails. The court says in an unsigned opinion that "no live dispute remains between the parties."

Greek court limits travel for Turkish officer seeking asylum

Greece's highest court has imposed severe restrictions on the movements of one of eight Turkish servicemen who have applied for asylum in Greece after fleeing Turkey following a failed 2016 coup there, while he waits for a decision on his asylum application.
The Council of State ruled that the officer will remain at an undisclosed address, must appear daily at a local police station and cannot obtain travel documents until his asylum application is determined in May.
Courts had initially granted him asylum, but suspended the decision following a Greek government appeal.
The eight helicopter crewmen, who deny involvement in the attempted putsch, have become a bone of contention in increasingly souring Greek-Turkish relations. Turkey demands they be returned as coup plotters, but Greek courts have rejected the extradition requests. |

The Minnesota Supreme Court has upheld a 2015 law limiting State Auditor Rebecca Otto's duties.
Wednesday's unanimous decision ends Otto's years of challenges and mounting legal fees. A district court and the Minnesota Court of Appeals had previously ruled against Otto, triggering her appeal to the Supreme Court.
The legal saga began after the Legislature passed a law allowing more counties to hire private firms for annual financial audits. Otto has argued that law was a constitutional breach of her duties that significantly downgraded the state's oversight of county finances.
But the state's high court disagreed. Wednesday's ruling maintained that the law left the auditor's oversight of those private audits intact. A spokesman for Otto did not immediately return a request for comment. |

Supreme Court rejects appeal from Middle East attack victims

The Supreme Court is rejecting an appeal from American victims of terrorist attacks in the Middle East more than a decade ago.
The justices are not commenting Monday in ending a lawsuit against the PLO and Palestinian Authority in connection with attacks in Israel in 2002 and 2004 that killed 33 people. A lower court tossed out a $654 million verdict against the Palestinians.
The Trump administration sided with the Palestinians in calling on the high court to leave the lower court ruling in place. The federal appeals court in New York said U.S. courts can't consider lawsuits against foreign-based groups over random attacks that were not aimed at the United States.
The victims sued under the Anti-Terrorism Act, passed to open U.S. courts to American victims of international terrorism.

Sales of diesel cars in Germany drop after court permits ban

German officials say there's been a sharp drop in sales of new diesel cars, following a court decision that allows cities to ban the use of heavily polluting vehicles.
Figures released Wednesday by the Federal Motor Transport Authority show new registrations of diesel-powered cars dropped by 25.4 percent in March to under 109,000, compared with about 146,000 during the same month a year earlier.
Germany's top administrative court ruled Feb. 27 that cities can ban diesel cars and trucks to combat air pollution. The decision is a further blow to diesel fuel technology after the revelations that German automaker Volkswagen cheated on U.S. emissions tests.
The value of diesel vehicles in Germany already had fallen significantly, and their market share has fallen since the VW scandal broke in 2015. |
